Terms and Conditions for Affiliate Marketing Program
Welcome to JessieMart’s Affiliate Marketing Program! These Terms and Conditions (“Terms”) govern your participation in the affiliate marketing program (“Program”) offered by JessieMart (“Company”, “we”, “our”, or “us”). By signing up for or participating in the Program, you (“Affiliate”, “you”, or “your”) agree to comply with and be bound by these Terms. If you do not agree, you may not participate in the Program.
1. Program Enrollment
1.1 Eligibility: To participate, you must be at least 18 years old and comply with applicable laws and regulations in India.
1.2 Application: You must submit an accurate and complete application. We reserve the right to accept or reject your application at our sole discretion.
1.3 Account Information: You are responsible for maintaining accurate information in your account, including payment details.
2. Affiliate Responsibilities
2.1 Promotion: You agree to promote JessieMart products and services in a lawful and ethical manner.
2.2 Prohibited Activities: You shall not engage in any of the following activities:
- Misleading or deceptive marketing.
- Using spam, unsolicited emails, or other forms of unauthorized advertising.
- Violating intellectual property rights, including unauthorized use of our logo or trademarks.
- Engaging in any activity that harms JessieMart’s reputation.
- 2.3 Compliance: You must comply with all applicable laws, including but not limited to India’s Consumer Protection Act, 2019, and related advertising guidelines.
3. Affiliate Links and Tracking
3.1 Unique Links: You will be provided with unique affiliate links for tracking purposes. Use only these links to promote our products.
3.2 Accuracy: It is your responsibility to ensure affiliate links are properly formatted and functional.
3.3 Tracking Limitations: JessieMart is not responsible for tracking errors due to technical issues, user actions, or third-party interference.
4. Commission and Payments
4.1 Commission Structure: Commissions will be paid based on the agreed-upon percentage of qualifying sales generated through your affiliate link.
4.2 Qualifying Sales: A sale qualifies only if the customer completes the purchase without cancellation or refund within the specified return period.
4.3 Payment Schedule: Commissions will be paid monthly, provided you meet the minimum payout threshold of INR 1,000. 4.4 Payment Method: Payments will be made via bank transfer or other approved methods as specified in your account settings.
4.5 Taxes: Affiliates are responsible for reporting and paying applicable taxes on their earnings.
5. Intellectual Property 5.1
License: JessieMart grants you a non-exclusive, non-transferable, revocable license to use its trademarks, logos, and promotional materials solely for the purpose of participating in the Program.
5.2 Restrictions: You may not modify, alter, or create derivative works of JessieMart’s intellectual property.
6. Termination
6.1 By JessieMart: We may terminate your participation in the Program at any time with or without cause by providing written notice.
6.2 By Affiliate: You may terminate your participation at any time by notifying us in writing.
6.3 Consequences of Termination: Upon termination, you must remove all affiliate links and cease promoting JessieMart products. Outstanding commissions may still be payable for qualifying sales made prior to termination.
7. Disclaimers and Limitation of Liability
7.1 No Warranties: JessieMart makes no warranties regarding the Program, including its availability or accuracy.
7.2 Limitation of Liability: To the maximum extent permitted by law, JessieMart’s liability for damages arising from your participation in the Program is limited to the amount of commissions earned by you.
8. Governing Law and Dispute Resolution
8.1 Governing Law: These Terms are governed by the laws of India.
8.2 Dispute Resolution: Any disputes arising from these Terms shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996, with the venue in Bengaluru, Karnataka.
9. Amendments We reserve the right to amend these Terms at any time. Changes will be communicated to you, and your continued participation in the Program constitutes acceptance of the amended Terms.
